Privacy Policy

This privacy policy (“Privacy Policy”) applies to the website including dedicated areas reserved to registered users (hereinafter “Website” or 'Site') and describes the data processing activities performed by ArtNetWorth S.r.l. (hereinafter, 'Digitag') through the Website, which is owned and managed by Digitag. Digitag recognizes the importance of the privacy of its users and is committed to protect it. Digitag processes user personal data when users visit the Website and make use of its services and functionalities. The Privacy Policy has been drafted according to the Recommendation n. 2/2001 dated May 17, 2001 issued by Article 29 Data Protection Working Party (Minimum requirements for the collection of data on-line within the European Union). The Privacy Policy also represents the information statement under Art. 13 of the “Privacy Code” (Legislative Decree June 30, 2003 n. 196 and further amendments and integrations). The Privacy Policy identifies who is the Controller that manages the data collected through the Website, specifies what personal information is collected, the data processing purposes and conditions, the extent of the communication of user’s data to third parties, the data security measures adopted to protect data and how user may enforce the privacy rights acknowledged by the Privacy Code.

2. The nature and kind of data processed

When visiting the Website no personal data will be collected or processed, since the data processing is limited to the so called surfing data, data whose transmission to the Website is necessary to allow the functioning of the information systems that manage the Website and more generally the use of Internet communications protocols. Surfing data intended as: the computer’s IP addresses or domain names used to visit the Site together with other parameters on the relevant operating systems. Digitag collects this data and other data such as the number of visits and the time spent on the Website only for statistical purposes and in anonymous form to monitor the correct functioning of the Website and improve its functionalities. Digitag does not collect surfing data to associate it with other user’s information or to identify users. However, by their nature, surfing data may allow the identification of user by association with other information owned by third parties. Surfing data collected for the abovementioned purposes are deleted immediately after the processing; Digitag may use said data to assess possible responsibilities for crimes against the Website or realized through the Website. With this exception, Digitag keeps surfing data only temporarily and according to applicable legislation. As regards to the use of Cookies, please refer to the below section 5, 'Cookies'.

Digitag collects and processes personal data voluntarily provided by the user upon interaction with the Website’s functionalities requesting the services offered by Message for you. For example when the user subscribes to the Website, to the newsletter, to the mailing list, purchases products, takes part in initiatives realized through the Website, requests information and services or sends communications to Digitag. The foregoing also applies to other websites, mobile and Internet applications of Digitag or of related companies subject to joint control, and to data provided by the user during the interaction with Digitag managed by Digitag or by its affiliated and companies subject to joint control ('Digitag companies'), for example data provided by filling out customer cards in shops or informally during visits to the stores. As permitted by the Privacy Code, Digitag may also process user’s personal data obtained from third parties in the course of its business activity and with the user’s consent, Digitag may further process user’s personal data for survey and market research purposes, for profiling purposes, for marketing and promotional purposes. The Digitag companies acting as data Controllers even outside of the European Union will use data for the same purposes. For more information on the processing purposes please refer to section 3 below.

Digitag may collect the following information: name and surname, date of birth, e-mail. While purchasing through the Site, other information is required such as identification codes (eg tax code, VAT number), contact information such as address, phone number, and other information of an optional nature.

Thorugh Digitag, users may scan - with a portable device (such as mobile phones or tablets) - a QR Code positioned on the packging of products, or may insert an ID number in the dedicated area on the Website Message for you, where users can upload a personalized message with multimedia contents (photos, viedos, text etc.) in accordance with the General Terms and Conditions of Digitag, provided that such message may be modified any time by the user. Such personalized message is private and it is shown by Digitag only to the recipient or recipients indicated by the users which may open the message only by scanning the said QR Code or by inserting the ID personal number on the Website. The recipient of such message may register to the service of Digitag and providing the abovesaid personal data will be treated in accordance with this Privacy Policy.

Digitag strongly recommends the users, not to upload confidential information or sensitive data, strictly personal or information which may harm the user or any other third party and levy Digitag from any related liability. In particular Digitag recommends users not to insert in the message their physical address, information related their economical status, political or sexual opinions, its state of illness, etc.

If users provide Digitag with personal data of third parties, users shall make sure data is compliant with the terms and conditions and applicable legislation specified in the relevant privacy statement in compliance with the Privacy Code, so for example users may provide third parties’ data only after having duly informed them and having obtained their consent if requested by the Privacy Code.

3. What are the purposes and how Digitag processes personal data; the nature of data provision and the consequences in case of refusal

In addition to the so-called surfing data (please refer to section 2 above) Digitag may process personal data voluntarily provided by users when users interact with Message for you functionalities to receive the services of Digitag. Digitag will process user’s personal data for the following purposes: managing the subscription to Message for you, newsletters or mailing lists, managing the purchase of products through the Site (which includes all activities related to the sale and after-sale services, such as for example administrative and accounting activities, fraud prevention, managing of returning items, guarantee, customer support, interaction with Digitag customer service), managing the participation in promotions and other initiatives organized through the Website, to reply and to manage user’s request for information, questions, communication or feedback to Digitag. User’s personal data will also be processed by Digitag to comply with obligations imposed by laws, regulations and Community legislation (including money laundering legislation) and to establish or defend a legal claim of Digitag.

For the purposes described above, the acceptance for the treatment of personal data of the user is necessary, and any refusal would prevent Digitag from performing its contractual obligations and providing services and goods to the users. Users will not be able to use the features of the Website and to obtain the required information, as mentioned above.

With the user’s consent, Digitag may also process user’s personal data for survey and market research purposes, for profiling purposes, for sending to user, also through e-mail, sms and mms promotional information and material on products of Digitag and Digitag companies, for special initiatives on prices and promotions such as events, exhibitions and fairs organized by Digitag and Digitag companies or that they participate in, including relevant invitations, as applicable. Users will have the opportunity to refuse receiving promotional e-mails; in each communication it will be explained how to refuse future promotional e-mails.

For the purposes described above, the consent to treat personal data by the user is optional and any refusal could prevent Digitag from performing its contractual obligations and providing services and goods to the users. Users will not be able to use the features of the Website and to obtain the required information, as mentioned above.

Digitag processes personal data mostly through electronic and automated means whose procedures and logics are defined according to the purposes herein specified. Data may also be processed in paper form. Digitag keeps data only for the time that is necessary to fulfill specific purposes that are sought from time to time.

4. Extent of personal data communication and transfer abroad

User’s personal data will be shared according to this Privacy Policy and the information statement published on the Website in the sections where data is collected, always in compliance with the consent given by the user upon data collection, if required by the Privacy Policy. User’s personal data will be accessible within Digitag on a need-to-know basis by its personnel as persons charged with data processing operations and by the Processor mentioned in section 7 of this Privacy Policy. The updated list of Processors and of the subjects to which data may be communicated remains at user disposal free of charge upon request to Digitag and its Processor indicated in section 7. User personal data may be communicated to institutions, authorities, public entities, banks, financial institutions, professionals, independent consultants, also in associate form, business partners of Digitag, notably third parties to which it may revert to in relation to performance of business, professional and technical services functional to managing the Website and the processing purposes herein specified, and Digitag companies. User’s personal data may also be communicated to third parties in case of mergers, acquisitions, transfer of assets, products or other extraordinary operations. These third parties will be provided only with the information necessary to perform their respective functions; they agree to use the information received only for the processing purposes above specified, to keep it confidential and secure and to comply with applicable law. User’s personal data may further be communicated to whoever is the legitimate addressee under applicable laws, thus for example in case of judicial processes, upon request by courts and authorities or other legal obligation, and if Digitag in good faith holds the data communication as necessary to comply with obligations deriving from applicable legislation, to protect and defend the rights and property of Digitag and the Website. The third parties receiving the data will process them as Controllers, Processors or persons in charge of processing, as the case may be, for the same purposes specified in this Privacy Policy and according to applicable privacy laws.

Digitag companies acting as data Controllers will use personal data for the same purposes identified in section 3 of the Privacy Policy, including for example profiling and marketing activities. Some of the data recipients, for example Digitag companies may be resident in countries that do not provide an adequate level of data protection as defined under the Privacy Code. User’s personal data will be transferred outside the European Union with adoption of appropriate precautions as required under applicable privacy law to guarantee their protection, security and confidentiality.

5. Cookies

Cookies are small text files sent to the device of the user by the visited website. Cookies are stored in the computer hard disk, thus allowing the website to recognize user and store certain information concerning them, in order to permit or improve the service offered.

There are different types of cookies. 5.3 Geolocalization and interactions with other mobile applications

QR Code scan system developed by Digitag, does not allow a geolocalization of the product through the QR code and does not localize the user or the recepient of the message uploaded on Message for you. However, should this feature be necessary, Digitag shall inform the users, through a message on the mobile device expressly requiring the authorization of the user or of the recipient of the message to have access on his current geographical position. Message for you is web responsive and created for also portable devices, and might interact with other applications downloaded in such portable devices. In order to provide with specific services, Digitag may require access to data released by such other applications (including but not limited to the recorder, camera, images, contacts, music, etc.). Before accessing any data release by such other applications, Digitag will always require to the user or to the recipient of the message, the expressed authorization to use such data through a specific message. The user or the recipient of the message may always refuse to give the above said authorizations or may revoke anytime the authorization already given, through the privacy setting tools found on the portable device, provided that in this case Digitag may not be able to provide its services.

6. User’s rights

Users are entitled at any moment to enforce the rights acknowledged under Art. 7 of the Privacy Policy, including for example to obtain the consent to verify personal data existence, verify their content, origin, accuracy, ask for their integration, updating, amendment, deletion, transformation in anonymous form, block for breach of laws, or oppose for legitimate reason any data processing. For any request on the personal data processing by Digitag and to enforce privacy rights user may contact Digitag at the email address below. This Privacy Policy is subject to updating and amendment. The version published on the Website is the version currently in force. Changes to this Privacy Policy will be communicated by placing a notice on Message for you with the date of the last update. Digitag invites users to periodically review the Privacy Policy to be informed of any relevant change.

Digitag is committed to protect the security of user’s personal data and complies with security provisions set forth by applicable laws and regulations to prevent loss of data, unlawful or unfair use of data and unauthorized access to data, with specific but not limited reference to Annex B of the Privacy Code (Technical Specifications Concerning Minimum Security Measures). Moreover, information systems and software programs are configured by reducing to a minimum the use of personal and identification data, which is used only if necessary for specific purposes that are sought from time to time. Digitag uses a variety of advanced security technologies and procedures to help protect user’s personal data. For example, personal data is stored on secured servers placed in controlled locations. Moreover, for the transmission of some data through the Internet, encryption techniques are employed such as the Secure Socket Layer (SSL) protocol. Users may help Digitag to update personal data by notifying Digitag of any amendment relating to user’s address, title, telephone number or e-mail address.
